AGREEMENT BETWEEN USER AND Boston Warehouse

The Boston Warehouse Web Site is comprised of various Web pages operated by Boston Warehouse.

The Boston Warehouse Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Boston Warehouse Web Site constitutes your agreement to all such terms, conditions, and notices.

MODIFICATION OF THESE TERMS OF USE
Boston Warehouse reserves the right to change the terms, conditions, and notices under which the Boston Warehouse Web Site is offered, including but not limited to the charges associated with the use of the Boston Warehouse Web Site.

SHIPPING & DELIVERY
Standard shipping methods include FedEx Ground, UPS Ground, USPS First Class Mail, and USPS Parcel Post. Orders are generally shipped within three business days via the best method available. Expedited shipping and international shipping are not offered at this time. Orders over $50 qualify for free standard shipping. Free shipping offers do not apply to expedited shipping or international shipping. Orders cannot be shipped outside the continental U.S.

PRIVACY & SECURITY

When you register for an account with Boston Warehouse you are asked to provide personal information such as name, phone number, and address. When you make a purchase as a registered user some payment information such as a credit card may be collected. Boston Warehouse will only use this information for the fulfillment of the goods and services it provides. The information is stored on secure servers and is not shared with any affiliates. Boston Warehouse may use the information to market its products, in such case you can opt out by removing yourself from our newsletter.

RETURNS & REPLACEMENTS
No returns may be made without consent. All claims must be made within 7 days of receiving your order. Damaged goods may be replaced or refunded. All other returns are subject to a 15% restocking fee.

ORDERING
Registration is highly recommended to place an order so that you can save common account settings such as addresses. If you experience any trouble while ordering please contact us at 1-800-811-2672 Monday through Friday 9 AM to 5 PM EST, or via the contact us page.

PAYMENT, PRICING & PROMOTIONS
Payment: Boston Warehouse accepts American Express, Discover, Visa, and MasterCard as valid payment methods.
Pricing: Boston Warehouse does not price-match with other retailers. We do, however, consistently work toward maintaining competitive prices on everything we carry.
Promotions: To qualify for a special promotion, your order must be placed during the specified promotional period. We are unable to apply special discounts to items ordered before or after the dates of a promotional offer.
Duties & Tax: Boston Warehouse will collect sales tax for orders shipping to Massachusetts. All other duties & taxes are the responsibility of the purchaser.

However, Boston Warehouse reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Boston Warehouse reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Boston Warehouse reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Boston Warehouse's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. TERMINATION/ACCESS RESTRICTION

Boston Warehouse reserves the right, in its sole discretion, to terminate your access to the Boston Warehouse Web Site and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in San Mateo County, California, U.S.A. in all disputes arising out of or relating to the use of the Boston Warehouse Web Site. Use of the Boston Warehouse Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
